When Hams Ask for More Enforcement: Law, Fees and Band Plans

A French petition raises a legitimate policy question, but “more regulation” bundles together several different things. Existing law, licence conditions, regulator capacity, voluntary band plans and criminal complaints each have their own scope.

The strongest case is not that paying an annual fee automatically produces cleaner bands. It is that a radio service needs clear rules, usable reporting channels, technically competent investigations and proportionate enforcement. A fee can be one way to finance public administration, but its amount, destination and results must be demonstrated rather than inferred from what an operator hears.

Evidence boundary and jurisdiction: the linked petition is privately authored advocacy addressed to ANFR, ARCEP and the French digital ministry. It alleges frequent interference, abuse and threats and asks for sanctions and restoration of the former annual tax. A petition establishes the request being made; it is not an official incident dataset, investigation record or adjudication. The legal material below is general information, not legal advice about any person or transmission. Always verify current national rules and reporting instructions with the competent authority.

Start by Separating the Five Layers

Layer What it does What it does not prove
ITU Radio Regulations The international treaty defines the amateur service, sets cross-border principles and places duties on national administrations. Article 25 requires operational and technical qualifications, leaves maximum power to administrations and requires call-sign identification. It does not create a general rule that amateurs must “police” one another, nor does it replace national enforcement and court procedures.
CEPT/ECC recommendations CEPT Recommendation T/R 61-01 facilitates temporary operation across participating countries and requires visitors to follow the host country’s rules. CEPT is not the EU legislature, and a CEPT recommendation is not a Europe-wide criminal or conduct code. National implementation and licence conditions still control.
National law and authorisation France, Belgium and the Netherlands set their own permitted bands, powers, modes, identification, station and operator requirements, complaint routes and sanctions. A rule or fee in one country cannot be assumed to apply in another.
Band plans and coordination IARU regional band plans organise modes and activities to reduce avoidable conflict. Repeater coordinators and national societies add practical coordination. IARU says observance is usually voluntary unless an administration incorporates a plan into national rules. Bad operating practice is not automatically a statutory offence.
Community ethics and policy opinion Operators can promote courteous practice, document interference, coordinate facilities and advocate budgets or legal reform. A petition, recording or strongly held view does not itself establish guilt, intent, causation or regulator failure.

This distinction matters because “regulation” and “enforcement” are not synonyms. Asking an authority to investigate deliberate interference under an existing rule is an enforcement request. Asking parliament to restore a charge, create a new offence or change an agency budget is a policy request. Asking operators to keep clear of a voluntary activity centre is coordination. Mixing the three makes both the engineering and the legal argument weaker.

France: The Tax Ended, the Regulatory Framework Did Not

France abolished the annual amateur-radio licence tax in Article 26 of the 2019 finance law. ANFR’s own January 2019 notice described the former amount as €46 and said that its amateur-service missions unrelated to tax collection remained unchanged. That history does not support the claim that the old payment was a dedicated enforcement fund, or that restoring the same charge would automatically buy a specified number of investigations.

The current division of responsibility is more useful than the slogan. ANFR administers amateur certificates and call signs and handles spectrum control; ARCEP sets national conditions of use within its statutory remit. ANFR’s current legal-framework page points to the French operating decision and to possible penal sanctions for interference or non-compliance. Its radio-amateur FAQ tells an operator who remains affected after checking the receiving installation how to submit an interference case, and notes that the fixed station must first have been declared.

France therefore has both amateur-radio rules and an official reporting route. Assessing enforcement performance requires comparable data on reports, admissibility, investigation time, findings and outcomes. General spectrum-control activity cannot by itself supply an amateur-specific performance measure.

Not every objectionable transmission is the same legal problem. Operating outside an authorisation, failing to identify and causing or deliberately generating interference are spectrum matters. A threat, discriminatory abuse or defamation may engage other parts of national law and other competent authorities. A spectrum complaint should not be treated as the only route for an immediate safety threat, and a radio recording should not be presented as a final legal classification.

The petition asks public bodies to treat persistent on-air disruption seriously and proposes a funding mechanism. Its allegations remain allegations, and the proposed tax should be evaluated through its legal form, destination, service commitments, access effects and measurable outcomes.

Belgium: A Real Annual Authorisation, but No Proven “Clean-Band Dividend”

Belgium does have a different administrative model. BIPT’s current amateur page distinguishes the operator certificate from the station authorisation: the certificate permits operation, while a station owner also needs a station authorisation. The page includes 2026 annual billing information and warns that an expired station authorisation does not permit continued use while waiting for the new one.

BIPT also has visible enforcement capacity. Its National Spectrum Monitoring Service accepts interference reports involving amateur communications, conducts field work and states that its technicians have judicial-police powers for radio-law offences.

Those facts establish that Belgium charges for authorisation and operates a monitoring service. They do not establish that an individual amateur’s annual payment is ring-fenced to amateur-band cases, that Belgian bands are uniformly “clean”, that misconduct is quickly identified, or that the fee caused any observed difference from France or the Netherlands. BIPT says the institute is funded mainly from the regulated sectors, but its public amateur material does not provide the cost allocation or controlled comparison needed for that causal claim.

“The fee is cheap insurance” is therefore an intelligible personal opinion, not a measured regulatory result. A defensible version of the argument would ask BIPT to publish service-level and outcome data: amateur complaints received, technically actionable cases, median first response, field investigations, confirmed infringements, remedies and appeals. The same metrics would make cross-country comparisons much more informative than an evening of tuning.

The Netherlands: Repeater Reports and Social Control Share the Work

RDI recognises repeater interference and misconduct as report categories. It provides a dedicated address for reports describing where, when and how intruders are heard on Dutch repeaters. RDI says listener observations can help locate a transmitter and support a targeted investigation.

The same guidance says misconduct by licensed amateurs can be reported but initially calls for social control within the amateur community. That is a stated division of work, not a transfer of enforcement power to volunteer repeater teams. RDI says it checks whether equipment complies and takes measures where necessary; it may contact a reporter when a message leads to a formal interference case. Without comparable outcome data, the Dutch, Belgian and French systems cannot be ranked or their on-air cultures attributed to fee policy.

“Self-Policing” Is Useful Shorthand, Not a Transfer of State Power

Amateurs can solve many operating conflicts cooperatively: check whether a signal is local receiver overload, compare antennas, coordinate a repeater pair, follow the regional band plan, ask a station to correct an over-wide signal and provide technically competent observations to the regulator. These practices reduce avoidable cases and help an authority act on the difficult ones.

But operators cannot compel records, search property, impose an administrative sanction or determine criminal guilt. Public accusation and direction finding by an informal group can also misidentify a source: strong audio is not proof of location, a relayed transmission can disguise origin, receiver intermodulation can create a signal that is not on the air, and a copied call sign does not authenticate the transmitter.

The ITU framework reflects this boundary. Article 25 places qualification and maximum-power decisions with administrations; Article 15 calls for cooperation between administrations in detecting and eliminating harmful interference. Community assistance can improve the evidence. It does not replace competent authority, due process or the applicable national law.

Build an Interference Report Like an Engineering Record

A regulator can act faster when the report distinguishes an unwanted signal from a suspected offence and preserves enough information to reproduce the observation.

  1. Rule out the receiving station. Check overload, preamp state, attenuator response, AGC, nearby electronics, coax faults and intermodulation. Repeat with a second receiver or antenna if practical.
  2. Record time and frequency precisely. Use UTC, frequency, mode, occupied bandwidth, receiver settings, antenna and location. Keep raw audio, spectrum captures or IQ data where lawful; do not submit only edited clips.
  3. Describe the technical effect. Note whether the wanted communication became unintelligible, a repeater input was held, a safety-related service was affected or a licence condition appeared to be breached. “Annoying” and “harmful interference” are not automatically interchangeable.
  4. Separate observation from attribution. Write “call sign X was spoken” rather than “licensee X transmitted” unless the identification is independently established. Preserve corroborating observations and calibrated bearings with their uncertainty.
  5. Show repetition without provoking it. Maintain a dated event log and avoid on-air retaliation, doxxing or transmissions intended to induce further misconduct.
  6. Use the correct route. Follow ANFR, BIPT or RDI instructions for spectrum cases. Use the appropriate emergency, police or judicial route for an immediate threat or another matter outside spectrum enforcement.

A waterfall is not a verdict. It can show energy at a receiver reference plane; it does not by itself prove transmitter identity, intent, geographic origin, legal status or whether the receiver generated the product. Technical evidence becomes much stronger when multiple independent stations preserve timestamps, raw records, receiver configurations and bearing uncertainty.

If a Fee Is Proposed, Specify the Contract

A serious proposal for a new or restored charge should answer:

  • Is the payment a tax, an administrative station-authorisation fee or a legally earmarked levy?
  • Which authority receives it, and can the revenue be used only for spectrum monitoring?
  • What staffing, monitoring coverage, response time and publication duties does it buy?
  • Will exemptions or reduced rates prevent exclusion of students, clubs and low-income operators?
  • What due-process, privacy, evidentiary and appeal safeguards apply?
  • How will outcomes be compared with the pre-fee baseline?

Enforcement capacity costs money, but a flat charge is only one funding design. General revenue, sector-wide contributions and targeted appropriations are alternatives. The engineering objective is not to maximise regulation; it is to minimise harmful interference and unsafe or unlawful operation at a proportionate cost while preserving experimentation and access.

What a Petition Can and Cannot Establish

It shows that at least one French amateur and the petition’s supporters want stronger action against alleged persistent misconduct and are willing to discuss paying for it. It does not, by itself, establish the number of offenders, nationwide listening exposure, the disposition of complaints, the comparative cleanliness of three countries or the effect of an annual fee.

The durable policy lesson is narrower and stronger: voluntary norms work best when the binding rules are clear, technically credible reports are easy to submit, responsibilities are not confused and enforcement outcomes can be audited. Sometimes that justifies additional resources. Sometimes the missing element is coordination, evidence quality or transparency rather than a new rule.
